1. Agreement
These Terms of Service ("Terms") govern your use of the Dietly mobile application ("the App"), operated by Jelte Ludeke, based in the Netherlands ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
2. The service
Dietly helps you track food intake, calories, macronutrients, water, and body weight, and provides goal-based targets, streaks, and reminders. Some features require an active Dietly PRO subscription.
3. Not medical advice
The App provides general wellness information only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Calorie and nutrition figures are estimates and may contain inaccuracies. Always consult a qualified healthcare professional before making significant changes to your diet, especially if you are pregnant, under 18, have an eating disorder history, or have a medical condition. If the App's guidance ever conflicts with advice from your doctor, follow your doctor.
4. Subscriptions & payment
- Dietly PRO is offered as an auto-renewing subscription (monthly, 3-month, or yearly), purchased through the app store you downloaded the App from — your Apple Account (App Store) or Google Account (Google Play).
- Where offered, new subscribers receive a 7-day free trial. You can cancel during the trial at no charge.
- Payment is charged to your Apple Account or Google Account at confirmation of purchase (or at the end of the free trial if not cancelled).
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel anytime — on iOS: Settings → your name → Subscriptions; on Android: Play Store → Profile → Payments & subscriptions. Deleting the App does not cancel a subscription.
- Prices are shown in the App before purchase and may vary by region. Price changes apply only to subsequent renewal periods, with notice as required by the relevant app store's rules.
- Refunds are handled by the app store under its standard policies — for Apple, request one at reportaproblem.apple.com; for Google Play, use the Play Store refund process.
5. Acceptable use
You agree not to misuse the App, including by reverse-engineering it, attempting to access our services in an unauthorized way (including scraping or bulk-extracting the food database), interfering with its operation, or using it in violation of applicable law.
6. Your content & data
Your diary entries, profile, and history are stored on your device and remain yours. Our handling of data is described in the Privacy Policy, which forms part of these Terms. You are responsible for keeping backups (the App includes an export feature); we are not liable for loss of locally stored data, for example if you lose or reset your device.
7. Intellectual property
The App, its design, branding, and content (excluding your personal data) are owned by us or our licensors and are protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable licence to use the App on devices that you own or control, as permitted by the terms of service of the app store you obtained it from.
8. Availability & changes
We may update, change, or discontinue features at any time, and we may release updates that are required for continued use. We aim for high availability of online features (such as food search) but do not guarantee uninterrupted service.
9. Termination
You can stop using the App at any time by deleting it. We may suspend or terminate access if you materially breach these Terms. Sections that by their nature should survive (disclaimers, limitations of liability, governing law) survive termination.
10. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of nutritional data, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or loss of data or profits, arising from your use of the App. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded under applicable law — including your statutory rights as an EU consumer, which remain unaffected.
12. App store terms
These Terms are between you and us, not Apple or Google. If you obtained the App from the Apple App Store: Apple has no obligation to provide support or maintenance for the App and is not responsible for addressing any claims relating to it, and Apple is a third-party beneficiary of these Terms and may enforce them against you. If you obtained the App from Google Play, the Google Play Terms of Service also apply to your download.
13. Governing law
These Terms are governed by the laws of the Netherlands. If you are a consumer in the EU, you also benefit from mandatory provisions of the law of your country of residence, and you may bring disputes before the courts of that country. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest version, and material changes will be communicated in the App. Continued use after changes take effect constitutes acceptance.
